Texas Uniform Planned
Community Act
The Texas Uniform Planned
Community Act is a legislative initiative
sponsored by the Texas College of Real
Estate Attorneys. TUPCA provides a balanced,
uniform, statewide law for the creation and
operation of mandatory homeowner
associations. If enacted by the Texas
Legislature in 2007, TUPCA may be the first
state statute in the country to devote an
entire chapter to protecting the rights of
individual homeowners.

Conduct of Meetings for Community Associations
Building Community
Homeowner associations have
been subjected to extremely negative publicity
during the past few months. A recent cartoon in
the Houston Chronicle characterized communications from homeowner
associations as less desirable
than IRS audits. This is very unfortunate and
needs to be addressed by the
leaders and management of community
associations. The value of community
associations and what they do is not very
newsworthy, and we therefore need to be aware of the facts to place the negative
publicity into proper perspective.

Community Association Aerial Antenna and
Satellite Dish Issues - After losing many
cases that upheld community association aerial
antenna and satellite dish restrictions, video
programming providers sought relief from the
United States Congress. Congress responded by
enactment of the Telecommunications Act of 1996
(the "Act"). The Act was determined by Congress
to be in furtherance of one primary objective of
the Communications Act of 1934 "to make
available, so far as possible, to all the people
of the United States . . . a rapid, efficient,
nation-wide, and world-wide wire and radio
communication service with adequate facilities
at reasonable charges . . .". The Act was viewed
as a recognition of the virtues of new
technology by service providers and many users
anxious to obtain such services, but with a
great deal of skepticism and trepidation by
community associations and others.
