Community Association Aerial Antenna and Satellite Dish Issues - After losing many cases that upheld community association aerial antenna and satellite dish restrictions, video programming providers sought relief from the United States Congress. Congress responded by enactment of the Telecommunications Act of 1996 (the "Act"). The Act was determined by Congress to be in furtherance of one primary objective of the Communications Act of 1934 "to make available, so far as possible, to all the people of the United States . . . a rapid, efficient, nation-wide, and world-wide wire and radio communication service with adequate facilities at reasonable charges . . .". The Act was viewed as a recognition of the virtues of new technology by service providers and many users anxious to obtain such services, but with a great deal of skepticism and trepidation by community associations and others.
