Homeowner Associations The bankruptcy filing
automatically stays any collection on the judgment.
Faced with additional expenses and the misconception
that a discharge of personal liability also means a
discharge of the association's lien, many
associations have chosen to end their collection
efforts upon receipt of the homeowner's bankruptcy
notice.

HOMEOWNERS' ASSOCIATIONS REVISITED - CAN
THEY REALLY MAKE YOU PARK YOUR RV IN A
GARAGE? You may recall that
last year I told you about how homeowners'
associations enforce their rules, using as
an example the story of an elderly woman in
Glendale who lost her house in a foreclosure
by her homeowners' association. Now there is
a reported case in Tucson that provides
another example of homeowners' association
rules and how they are enforced. The case
also demonstrates how those rules can
interact with other rules governing
property, in this case the Fair Housing
Amendments Act (the "FHAA"). Once again, the
case provides a demonstration of how
homeowners' associations enforce their
rules, and how not to respond when you get
into a dispute with your homeowners'
association.

Flag Flying Laws & Legislation - As of
August 22, 2003, Arizona HOA's are
prohibited from preventing members from
flying the U.S. Flag, in accordance with the
Arizona Revised Statutes:

associations making life miserable for their
members. This does occasionally occur, and
homeowners associations do have considerable
power over the homeowners within their
jurisdiction. Their powers are not without
limits, however, and they do have certain

Arizona Revised Statute Section 33-439
essentially prohibits any HOA (Home
Owner Association) from unduly
restricting the installation of solar
energy devices.

Open Meeting Law (ARS. §§ 38-431 through

The Homeowners'
Association: Angel or Devil?
Homeowners' associations, or HOAs, are
formal legal entities created to maintain
common areas and enforce deed restrictions.
Most condominium and townhome developments,
and many newer single-family subdivisions
have HOAs, which are usually created when
the development is built. Covenants,
Conditions & Restrictions (CC&R's) are
issued to each homeowner, and HOAs are
established to ensure that they are adhered
to in order to maintain the quality and
value of the properties involved.
